The Buyer's right of withdrawal and return
1. Pursuant to Section 4(2) of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, only a natural person acting outside the scope of their profession, independent occupation, or business activity qualifies as a consumer under Section 8:1(1)(3) of the Civil Code.
Consumers are entitled to the right of withdrawal without justification according to Section 20 of Government Decree 45/2014 (II. 26.).
The consumer may exercise the right of withdrawal:
a) In the case of a contract for the sale of goods, within a deadline of 14 days from the date of receipt of the product, or in the case of multiple goods ordered by the consumer where the products are delivered at different times, from the date of receipt of the last product or the product designated by the consumer or a third party other than the carrier.
The provisions in this section do not affect the consumer's right to exercise the right of withdrawal between the conclusion of the contract and the receipt of the product.
If the consumer made an offer for the conclusion of the contract, the consumer is entitled to withdraw the offer before the conclusion of the contract, which terminates the binding nature of the offer for the conclusion of the contract.
2. Declaration of withdrawal, exercise of the consumer's right of withdrawal or termination
The consumer may exercise their right under Section 20 of Government Decree 45/2014 (II. 26.) by a clear statement to that effect or by sending a letter to hello@andyourstories.com.
3. Validity of the consumer's withdrawal declaration
The right of withdrawal shall be deemed to have been exercised in due time if the consumer sends their statement within the deadline. The deadline is 14 days.
The consumer bears the burden of proving that they exercised the right of withdrawal in accordance with this provision.
Upon receipt of the consumer's withdrawal declaration, the Seller is obliged to confirm it in writing on an electronic data carrier.
4. Seller's obligations in case of consumer withdrawal
Seller's refund obligation
If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall refund the full amount paid by the consumer as consideration within fourteen days from the date of notification of the withdrawal, including any costs incurred in connection with the performance, such as the shipping cost. Please note that this provision does not apply to additional costs resulting from the choice of a delivery method other than the least expensive standard delivery method.
Method of Seller's refund obligation
In the event of withdrawal or termination in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall refund the amount due to the consumer in the same manner as the payment method used by the consumer. With the express consent of the consumer, the Seller may use another payment method for the refund, but no additional charges may be imposed on the consumer as a result. The Seller shall not be liable for any delay caused by the consumer providing an incorrect or inaccurate bank account number or postal address.
5. Additional costs
If the consumer expressly chooses a delivery method other than the least expensive standard delivery method, the Seller is not obliged to refund any additional costs incurred. In this case, our refund obligation is limited to the general shipping fees indicated.
6. Right of retention
The Seller may retain the amount due to the consumer until the consumer returns the product or unequivocally proves that they have returned it; the earlier date shall be taken into account. Cash on delivery or postage-paid shipments cannot be accepted.
7. Consumer obligations in case of withdrawal or termination
Return of the product
If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), they are obliged to return the product immediately, but no later than fourteen days from the notification of withdrawal, either by sending it back or handing it over to the Seller or a person authorized by the Seller to receive the product. The return is considered timely if the consumer sends the product before the deadline expires.
Bearing the direct costs of returning the product
The consumer bears the direct cost of returning the product. The product must be returned to the Seller's address: Andyourstories Hungary Kft. 1033 Budapest, Szentendrei út 89-95. PP Center
If the consumer terminates a contract for the provision of services concluded outside the business premises or at a distance after the commencement of performance, they are obliged to pay a proportionate fee to the business for the services provided up to the time of notification of termination. The amount to be paid proportionately by the consumer shall be determined based on the total consideration specified in the contract including tax. If the consumer proves that the proportionate amount thus determined is excessively high, the proportionate amount shall be calculated based on the market value of the services provided up to the termination of the contract. Please note that we are unable to accept products returned cash on delivery or postage-paid.
Consumer responsibility for depreciation
The consumer is liable for any depreciation of the product resulting from use exceeding what is necessary to determine the nature, characteristics, and functioning of the product.
