7 Shipping
In exceptional cases, it may happen that the online store has to invoice a higher shipping fee than what is indicated in the shipping information. In such cases, the online store prepares a detailed breakdown of the fee and draws the Customer's attention to it before fulfilling the order.
If the Webshop needs to deliver the order in multiple steps due to technical or logistical reasons after the order has been placed, the shipping costs will of course only be charged once.
If the Customer notices any damage on the product or packaging during delivery, they must request the delivery person to draw up a report on the damages. 8 Warranty
8.1 Warranty
The Customer may assert a warranty claim against the Webshop in case of defective performance by the Webshop.
In the case of a consumer contract, the Buyer can assert their warranty claims for product defects that existed at the time of delivery within a 2-year limitation period starting from the date of receipt. Beyond the 2-year limitation period, they will no longer be able to enforce their warranty rights.
The entitled party can assert its warranty claims within a 1-year limitation period from the date of receipt in the case of a contract not concluded with a consumer.
The Customer - at their choice - may request a repair or replacement, unless fulfilling the chosen request by the Customer is impossible or would result in a disproportionate additional cost for the Webshop compared to fulfilling another request. If the repair or replacement is requested
Customer may request a proportional reduction of the consideration or the correction of the defect at the expense of the Webshop if the Customer has not requested or could not have requested it, or the Customer may correct it himself or have it corrected by someone else, or - as a last resort - may withdraw from the contract. Withdrawal is not possible due to a minor defect.
The consumer may switch their chosen warranty right to another one, but they must bear the cost of the switch, unless it was justified or the Online Store gave reason for it.
The customer is obliged to report the defect to the Webshop immediately after its discovery, but no later than 2 (two) months from the discovery of the defect.
The Customer can enforce their warranty claim directly against the Online Store.
Within 6 (six) months from the performance of the contract, there are no other conditions for asserting the warranty claim besides notifying the defect, if the Buyer can prove that the product was purchased from the Webshop (by presenting the invoice or a copy of the invoice). In such cases, the Webshop is only exempt from liability if it can rebut this presumption, that is, prove that the defect in the product occurred after it was handed over to the Buyer. If the Webshop can prove that the cause of the defect is attributable to the Buyer, it is not obliged to comply with the warranty claim raised by the Buyer. However, after 6 (six) months from the performance, the Buyer is obliged to prove that the defect recognized by the Buyer already existed at the time of performance.
If the Customer asserts their warranty claim regarding a specific identifiable defect of the product, the warranty claim shall not be considered as asserted for other parts of the product.
8.2 Product warranty
In case of a defect in the product (movable item), the Buyer qualifying as a Consumer may enforce the right specified in point 8.1 or the product warranty claim, at their choice.
However, the Buyer is not entitled to assert a warranty claim and a product warranty claim simultaneously for the same defect. In the event of a successful assertion of a product warranty claim, the Buyer may assert their warranty claim against the manufacturer for the replaced product or repaired part.
As a warranty claim, the Buyer can only request the repair or replacement of the defective product, that is, there is no possibility for monetary compensation, price reduction, or withdrawal, as there is no contractual relationship between the manufacturer and the consumer, the contract is missing. In case of asserting a warranty claim for a product defect, the Buyer must prove it.
A product is considered faulty if it does not meet the quality requirements valid at the time of placing on the market or if it does not have the properties specified in the description provided by the manufacturer.
The Customer may enforce the warranty claim within 2 (two) years from the date of the product's manufacturer release. After this deadline, the entitlement is lost. The Customer is obliged to notify the manufacturer of the defect without delay after discovering the defect. The defect
The error reported within 2 (two) months of its discovery must be considered as reported without delay. The Customer is responsible for any damage resulting from the delay in reporting.
The Customer may enforce their warranty claim against the manufacturer or distributor (Webshop) of the movable item.
According to the Civil Code, the manufacturer of the product is considered to be both the producer and the distributor.
The manufacturer, distributor (Webshop) is only exempt from product warranty obligations if it can prove that:
The product was not manufactured or placed on the market within the scope of business activities, or
The defect was not recognizable at the time of release according to the state of science and technology.
The defect of the product arises from the application of legislation or mandatory regulatory requirements.
To be exempted, the manufacturer or distributor (Webshop) only needs to prove one reason.
9 Warranty
The mandatory warranty for consumer goods is regulated by Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain durable consumer goods. The scope of the decree applies only to new products sold within the territory of Hungary under consumer contracts and listed in the annex of the decree.
The Webshop provides a 1-year warranty for all technical products purchased from it, which corresponds to the mandatory warranty period listed in the annex to the government decree for durable consumer goods.
The start date of the warranty is the day of handing over the product to the Buyer, or if the installation is carried out by the Webshop or its authorized representative, the day of installation. The Webshop validates the warranty certificate attached to the product when it is handed over for delivery to the Buyer.
The defect is not covered by warranty if it occurred after the product was handed over to the Customer, for example, if the defect
- improper installation (except if the installation was carried out by the Webshop or its authorized representative, or if the improper installation can be attributed to an error in the user manual) - misuse, disregarding the instructions in the user manual, - improper storage, mishandling, damage,
Elementary damage caused by a natural disaster.
In case of a defect covered by the warranty, the Customer
First and foremost - at your choice - you may demand repair or replacement, unless fulfilling the chosen warranty claim is impossible, or if it is the Webshop's other
By fulfilling the warranty claim, it would result in disproportionate additional costs compared to the value represented by the product in perfect condition, the severity of the breach of contract, and the damage caused to the Consumer by fulfilling the warranty claim.
If the Webshop did not undertake the repair or replacement within the deadline corresponding to its obligation, and cannot fulfill the interests of the Buyer while preserving them, or if the Buyer's interest in the repair or replacement has ceased, the Buyer - at their choice - may request a proportional reduction of the purchase price, have the defect corrected at the expense of the Webshop or by another party, or withdraw from the contract. Withdrawal is not possible due to a minor defect.
The repair or replacement - taking into account the characteristics of the product and the expected purpose by the Customer - must be carried out within an appropriate deadline, preserving the interests of the Customer. The Webshop must strive to perform the repair or replacement within a maximum of 15 (fifteen) days.
During the repair, only new parts can be installed in the product.
The time required for repair, during which the Consumer cannot use the product properly, does not count towards the warranty period. The warranty period starts again for the replaced (repaired) product (part) and for any defects resulting from the repair.
The costs related to fulfilling the warranty obligation are borne by the Webshop.
Consumers, however, are not entitled to assert a warranty claim and a guarantee claim, or a product warranty claim and a guarantee claim simultaneously for the same defect. Regardless of these limitations, Consumers are entitled to the rights arising from the guarantee separately from the entitlements defined in points 1) and 2).
