By using the Webshop and by providing the data required for the purchase, the User accepts and acknowledges the provisions of these GTC as binding upon him/her, and hereby acknowledges and accepts the following:

These Terms and Conditions apply to all the goods available and available for purchase on the andyourstories.com website (hereinafter referred to as "Webshop"). The technical information necessary for the use of the Webshop, which is not contained in the General Terms and Conditions (hereinafter "GTC"), is provided by other information available on the andyourstories.com website.

The contract concluded through the Webshop is not in writing, is not filed by Webshop and is therefore not accessible and cannot be consulted subsequently.

The Webshop is not subject to any code of conduct.

By using the Webshop or by providing the data required for the purchase, the Customer accepts and acknowledges the provisions of these GTC as binding on him/her, and acknowledges and accepts the following:

1 Identification of the contracting partner

2 Procedure for the purchase

The Webshop is only available in Hungarian.

You can find out about the detailed characteristics, price and availability of the product or service you wish to order by clicking on the product name or the image of the product. Click on "Add to cart" or the cart icon to add the product to your virtual cart.

Click on the basket icon to display and review the list of products that have been added to the basket and to finalise the order by clicking on the "Pay" button.

The purchase can be made by entering the delivery details as a guest or by logging in as a registered user. Once the Customer has entered all the details correctly, he/she has the option to select the payment method (PayPal or credit card payment) and complete the purchase by payment.

3 Confirmation, conclusion of contract

Once the Customer has sent his order, the receipt of the offer will be confirmed by an automatic email within 48 hours at the latest, which will confirm that the Webshop has received the order sent. The automatic email will also contain the details of your order ("Order Details"). This Order Details does not constitute acceptance of the order, but merely informs you that the order has been received by the Webshop.

The Webshop accepts the Customer's offer by means of a separate acceptance email. The contract is concluded upon receipt of the separate email of acceptance of the offer by the Webshop and not upon receipt of the automatic order confirmation email within 48 hours.

The Customer shall be released from the obligation to accept the offer if he does not receive from the Webshop without delay (within 48 hours) the confirmation email concerning the order he has sent.

If the Customer notices an error in the data contained in the confirmation email, he/she must notify the Webshop within 1 day in order to avoid the execution of unwanted orders.

The order shall be deemed to be a contract concluded by electronic means, which shall be governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The contract is subject to the provisions of Government Decree 45/2014 (26.02.2014) on the detailed rules of contracts between consumers and businesses and takes into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

4 Storage of the text of the contract

The order data are stored by the Webshop. If the Customer wishes to receive it in printed form, he/she can print out the order confirmation email, which contains all relevant information about the order. This will be sent to the email address provided by the Customer after the order has been placed.

5 Right of withdrawal

The provisions of this clause apply only to natural persons acting outside the scope of their profession, occupation or business activity who buy, order, receive, use or make use of goods and who are the addressee of commercial communications or offers relating to goods (hereinafter referred to as "Consumer").

The consumer is entitled, in the case of a contract for the sale of goods


a) to,

b) in case of sale of more than one product, if each product is supplied at a different time, to the last product supplied,

(c) in the case of products consisting of several lots or items, the last lot or item supplied,

(d) where the product is to be supplied regularly within a specified period, the first supply,


within fourteen (14) days from the date of receipt of the goods by the Consumer or a third party other than the carrier and indicated by the Consumer (hereinafter collectively referred to as the "Withdrawal Period"), the Customer may withdraw from the contract without giving any reason.

The consumer shall also have the right to exercise his right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the goods.

If the Consumer wishes to exercise the right of withdrawal, he/she must send a clear statement of his/her intention to withdraw (by post or by electronic mail) to the Webshop Operator using the contact details indicated in point 1 of these GTC during the Withdrawal Period. For this purpose, the Consumer may use the "Model Withdrawal Notice" in Annex 1 to these GTC.

The Consumer shall bear the burden of proving that he has exercised his right of withdrawal in accordance with the provisions set out in the relevant clause of these GTC. If the Consumer fails to send his declaration of withdrawal within the indicated time limit, in a manner that can be justified beyond reasonable doubt, this shall be deemed to constitute a failure to fulfil the conditions for exercising the right of withdrawal and the Consumer's contract shall not be terminated and shall remain in force.

In the case of a written withdrawal, it shall be deemed to have been validated within the time limit if the Consumer sends his/her declaration to this effect to the Webshop during the Withdrawal Period (up to the 14th calendar day).

In the case of notification by post, the date of posting shall be taken into account by the Webshop for the purpose of calculating the time limit, in the case of notification by email, the date of sending the email. The Consumer shall post his letter by registered mail so that the date of dispatch can be credibly proven.

The Consumer shall exercise his right of withdrawal within the time limit if he sends his notice of withdrawal to the Webshop before the expiry of the Withdrawal Period (14 days).

In the event of withdrawal, the Consumer must return the ordered product to the address indicated below without undue delay, but no later than 14 days from the date of notification of his/her withdrawal. The deadline is deemed to have been met if the Consumer sends (posts or delivers to the courier service ordered by the Consumer) the product before the 14-day deadline.

If the Consumer orders more than one product or service, he/she may withdraw from the contract for any or all of the products or services.

The cost of returning the product to the Webshop's address is borne by the Consumer. The Webshop is not able to accept the package returned by cash on delivery. No costs other than the cost of returning the product shall be charged to the Consumer in connection with the withdrawal.

If the Consumer withdraws from the contract, the Webshop will reimburse all the consideration paid by the Consumer, including the transport (delivery) costs, without delay, but no later than 14 days after receipt of the Consumer's notice of withdrawal, except for any additional costs incurred because the Consumer has chosen a transport method other than the cheapest standard transport method offered by the Webshop.

The Webshop is entitled to withhold the refund until it has received the product back or the Consumer has provided credible proof that he has returned it, whichever is the earlier.

For the refund, the Webshop shall use the same payment method as the one used for the original transaction, unless the Consumer expressly agrees to use another payment method; no additional costs shall be incurred by the Consumer as a result of using this refund method.

The Consumer shall only be held liable for depreciation of the product if it is due to use beyond the use necessary to establish the nature, characteristics and functioning of the product.

5.1 The consumer has no right of withdrawal

 in the case of a product which is not prefabricated, which has been produced by the Webshop on the instructions or at the express request of the Consumer, or in the case of a product which is clearly personalised for the Consumer,

 - for products in sealed packaging which, for health or hygiene reasons, cannot be returned after opening after delivery (e.g. cosmetics)

 - for the sale of a copy of a sound or video recording or computer software in sealed packaging, if the consumer has opened the packaging after delivery,

 -for a product or service whose price or charge is subject to fluctuations in the money market which cannot be controlled by the Webshop.

The goods to be returned must be accompanied by the delivery note and the reason for return. Failure by the Consumer to indicate the reason for returning the goods shall not constitute a loss of the right of withdrawal. In case of return, the parcel should be sent back to the following address:

6 Prices and delivery

The prices indicated next to the products in the Webshop are in Hungarian forints. Shipping costs are not included in the price of the product. The price is the price valid at the time of ordering.

The Webshop will inform the Customer about the delivery times during the respective ordering process. If the delivery time specified therein cannot be met, the Webshop will inform the Customer by email.

7 Delivery costs

For orders placed in the Webshop, a flat rate parcel delivery fee of HUF 990,- gross is payable for orders not exceeding HUF 10 000. This includes only part of the delivery/shipping and packaging charges, the remainder is borne by the Webshop Operator. For orders exceeding HUF 10,000, the Webshop Operator will bear the full shipping costs.

In exceptional cases, the Webshop may have to charge a higher delivery fee. In such a case, the Webshop will provide a detailed statement of the charge and draw the Customer's attention to this before the order is fulfilled.

If, for technical or logistical reasons, the Webshop has to deliver the order in several steps after the order has been placed, the delivery costs will of course only be charged once.

If the Customer notices any damage to the product or the packaging during the delivery, he/she must ask the person who made the delivery to record the damage. If the packaging or the product is visibly damaged at the time of receipt and the damage occurred before the goods were received, the Webshop will provide a return of the product free of charge. The Webshop is not liable for any damage discovered after receipt!

8 Warranty

8.1 Warranty for accessories

The Customer may assert a warranty claim against the Webshop in the event of defective performance by the Webshop.

In the case of a consumer contract, the Customer may assert a warranty claim within a limitation period of 2 years from the date of receipt for product defects that already existed at the time of delivery of the product. After the two-year limitation period, he may no longer enforce his rights under the warranty.

In the case of a contract concluded with a non-consumer, the right-holder may enforce his warranty claims during the limitation period of 1 year from the date of receipt.

The Buyer may, at his option, request repair or replacement, unless the fulfilment of the claim chosen by the Buyer is impossible or would involve disproportionate additional costs for the Webshop compared to the fulfilment of his other claim. If the repair or replacement is requested by the

Customer has not requested or could not have requested, the Customer may request a proportionate reduction in the consideration or the Customer may have the defect repaired or replaced by another party at the expense of the Webshop or, as a last resort, may withdraw from the contract. There shall be no right of withdrawal for minor defects.

The Customer may transfer the right of warranty of his choice to another, but he shall bear the cost of the transfer, unless it was justified or the Webshop gave a reason for it.

You are obliged to notify the Webshop of the defect immediately after its discovery, but no later than 2 (two) months after the discovery of the defect.

The Customer may assert a warranty claim directly against the Webshop.

Within 6 (six) months from the date of performance of the contract, no other condition for asserting a claim for a warranty claim other than notification of the defect shall apply if the Customer proves that he/she purchased the product from the Webshop (by presenting an invoice or a copy of the invoice). In such a case, the Webshop shall be exempted from the warranty only if it rebuts this presumption, i.e. proves that the defect in the product occurred after delivery to the Customer. If the Webshop is able to prove that the defect was caused by a cause attributable to the Customer, it is not obliged to accept the Customer's warranty claim. However, after 6 (six) months from the date of performance, the Customer shall be obliged to prove that the defect discovered by the Customer existed at the time of performance.

If the Customer asserts a warranty claim in respect of the part of the product which can be separated from the defect indicated, the warranty claim shall not be deemed to be asserted in respect of the other parts of the product.

8.2 Product warranty

In the event of a defect in the product (movable item), the Consumer may, at his/her option, assert the right set out in clause 8.1 or a product warranty claim.

However, the Buyer shall not have the right to assert both a warranty claim and a product warranty claim for the same defect at the same time. However, in the event of a successful product warranty claim, the Customer may assert his accessory warranty claim against the manufacturer for the replaced product or repaired part.

As a product warranty claim, the Customer may only request the repair or replacement of the defective product, i.e. no monetary remedy, price reduction or withdrawal is possible, since no contractual relationship has been established between the manufacturer and the consumer, and there is no contract. In the case of a product warranty claim, the burden of proof of the defect of the product lies with the Consumer.

A product is considered to be defective if it does not meet the quality requirements in force at the time of its marketing or if it does not have the characteristics described by the manufacturer.

The Customer may assert a product warranty claim within 2 (two) years of the date on which the product was placed on the market by the manufacturer. After this period has elapsed, the Buyer shall lose this right. The Buyer shall notify the manufacturer of the defect without delay after discovering it. The defect

defect within 2 (two) months of the discovery of the defect shall be deemed to have been notified without delay. The Buyer shall be liable for any damage resulting from the delay in notification.

The Customer may exercise his warranty claim against the manufacturer or distributor (Webshop) of the movable item.

For the purposes of the Civil Code, the manufacturer and distributor of the goods are also considered to be the manufacturer.

The manufacturer or distributor (Webshop) is only exempted from its product warranty obligation if it can prove that:

 did not manufacture or market the product in the course of its business, or

 the defect was not detectable according to the state of science and technology at the time of marketing, or

 the defect in the product results from the application of a law or a mandatory provision of a public authority.

The manufacturer or distributor (Webshop) only needs to prove one ground for exemption.

9 Warranty

The mandatory warranty for consumer goods is regulated by Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain consumer durables. The (subject) scope of the Regulation applies only to products sold under a new consumer contract concluded in Hungary and listed in the Annex to the Regulation.

The Webshop provides a warranty period of 1 year for all technical goods purchased from it, which is the same as the mandatory warranty period for consumer durables listed in the annex to the Government Decree.

The warranty period starts on the date of delivery of the product to the Customer or, if the installation is carried out by the Webshop or its agent, on the date of installation. The Webshop shall validate the warranty ticket enclosed with the product when it delivers the product to the Customer.

A defect shall not be covered by the warranty if its cause occurs after the product has been delivered to the Customer, for example, if the defect

 improper installation (unless the installation was carried out by the Webshop or its agent or if the improper installation is due to a fault in the instructions for use)  improper use, failure to observe the instructions for use,  improper storage, improper handling, damage,

 damage caused by natural disasters, natural disasters.

In the event of a defect covered by the warranty, the Buyer

 may, in the first place, at his option, demand repair or replacement, unless the chosen warranty claim cannot be fulfilled or the Webshop is unable to meet the other party's warranty claim.

would result in disproportionate additional costs compared to the fulfilment of a warranty claim, taking into account the value of the product in its original condition, the seriousness of the breach of contract and the damage caused to the Consumer by the fulfilment of the warranty claim.

 if the Webshop has not undertaken to repair or replace the goods, cannot fulfil this obligation within a reasonable period of time, without prejudice to the interests of the Customer, or if the Customer's interest in repair or replacement has ceased, the Customer may, at his/her option, request a proportionate reduction in the purchase price, repair the defect himself/herself or have it repaired by another party at the Webshop's expense, or withdraw from the contract. There is no right of withdrawal for minor defects.

The repair or replacement must be carried out within a reasonable period of time, taking into account the characteristics of the product and the intended use of the product as expected by the Customer, and without prejudice to the interests of the Customer. The Webshop must endeavour to carry out the repair or replacement within a maximum of 15 (fifteen) days.

During the repair, only new parts may be installed in the product.

The warranty period does not include the part of the repair period during which the Consumer cannot use the product as intended. In the event of replacement (repair) of the product or part of the product, the guarantee period shall start again for the replaced (repaired) product (part of the product) and for the defect resulting from the repair.

The costs of fulfilling the warranty obligation shall be borne by the Webshop.

The consumer shall not, however, be entitled to assert a warranty claim and a guarantee claim or a product warranty claim and a guarantee claim for the same defect at the same time and in parallel. Notwithstanding these limitations, the Consumer shall enjoy the rights under the warranty irrespective of the entitlements set out in points 1) and 2).

The contractual warranty does not affect the existence of any warranty rights.

10 Reservation of ownership

The goods remain the property of the Webshop until the purchase price has been paid in full. If, for any reason whatsoever, the goods come into the possession of the Customer before the purchase price has been paid in full, the Customer shall be liable to the Webshop for all damages, for which no one can be held liable.

11 Payment, due date, late payment

Online payment by credit card - for our Webshop convenient and secure online payment is provided by Barion Payment Zrt. Your bank card details will not be transmitted to our store. When you pay by credit card, you will be redirected to the Barion payment site, so the payment is made directly on their site, which operates according to the rules and security standards of international card companies, and not on the webshop site. The online shop does not have any form of access to your card or the details of your card or the account number and expiry date.

The Webshop Operator reserves the right to exclude certain payment methods in certain cases or to request an advance payment.

13 Enforcement options

13.1 Complaint handling

The Customer may submit consumer complaints about the product or the activities of the Webshop using the contact details provided above.

If Webshopa has the opportunity to do so, it will remedy the complaint immediately. If it is not possible to remedy the oral complaint immediately, due to the nature of the complaint, or if the Customer does not agree with the handling of the complaint, the Webshop will keep a record of the complaint for five years, together with its substantive response to the complaint, and send it to the Customer electronically.

The Webshop will respond to the complaint received in writing within 30 (thirty) days. Action under this Agreement shall mean posting.

If the complaint is rejected, the Webshop shall inform the Customer of the reasons for the rejection.

13.2 Other means of redress

If any dispute between the Webshop and the Customer is not resolved in the course of negotiations with the Webshop, the Customer may initiate court proceedings and, in the event of a consumer dispute, the following enforcement options are available to the Customer:

 Complain to the consumer protection authority,

 Initiate proceedings before a conciliation body

For the purposes of the rules on the conciliation body, a consumer is also a non-governmental organisation, a church, a condominium, a housing association, a micro, small or medium-sized enterprise within the meaning of a separate law, who buys, orders, receives, uses, makes use of goods or is the recipient of commercial communications or offers relating to goods.

15 Unilateral modification of the General Terms and Conditions

The Webshop Operator may unilaterally modify these Terms and Conditions at any time. The amended provisions shall apply to orders placed after their entry into force.

The Webshop Operator reserves the right to make any changes or improvements to the Webshop at any time without prior notice and to transfer the Webshop to a different domain name.

The effective date of these Terms and Conditions is 05.02.2019.
